Our bad West Palm Beach Contractor hired Pestana Roofing and Pestana was aware there were issues with the trusses, roof, drip edge and neither the bad Contractor or Al Pestana disclosed what was going on behind the scenes. The bad contractor installed icynene before the roof was finished. We learned after the bad Contractors abandonment and the roof was already on that he designed and ordered a different design truss system that was never disclosed or approved by me, the engineer of record or the City of West Palm Beach. The City never reviewed or approved what the bad contractor put on our house because he bypassed inspections. The roof is awful and never goes unnoticed. The wrong designed trusses, roof and drip edge with terrible workmanship will forever ruin the intended modern design and the only way to fix it is to take off the roof and trusses and start all over again.
It was difficult filing a claim with the General Liability insurance company. General Liability policies do not cover bad workmanship, wrong materials, not per plan and not to code work. Most contractors do not carry Builders Risk Insurance. At first I called the insurance broker and the broker refused to give me the insurance contact information. The broker told me he knows Pestana personally and he only does good work. I reported the broker to the insurance company. I am suing the bad Contractor and Pestana's damages are part of my lawsuit.
I filed a complaint with the Licensing Board, buy I unfortunately learned the Licensing Board ONLY regulates contractors who operate without a License. They DO NOT regulate bad workmanship, not to code work, incomplete work and people who run off with your money. Everything is a civil matter.
Pestana had the nerve to tell me he did not review my plans. What licensed contractor pretends that they did not review the permitted plans and how could Pestana bid a job without reviewing the plans? When I asked Pestana why he proceeded with the the drip edge when he knew the conditions were not right to proceed, he said, I told the Contractor it wasn't going to be good, but he still proceeded to install the wrong drip edge with a bad result. A licensed contractor should not proceed when they know the conditions are not going to be good and will cause the homeowner issues and aesthetic issues. Pestana proceeded to tell me he decided on the larger drip edge in different areas that started rusting right away because it was code. Pestana and the bad Contractor never discussed the change with me and it is different than what I designed on the permitted plans. I looked up the codes, contacted my new structural subcontractor and the building department to confirm if it was code because I could not find such a code and both said they are not aware of any such code. I wrote to Pestana requesting he forward the code language he was speaking of, but of course he was non-responsive. Pestana is also not warranting his work on our project.
Based on our experience with Al Pestana and Pestana Roofing, we would never recommend them because they proved to be a company we could not trust.
When the bad Contractor ran off abandoning the project, Pestana told me he completed the roof and I should pay him. I paid him to do the right thing even though his contract was with the bad contractor. I found out later, the roof was not completed and I learned of all the issues. If I had known, I would have never paid Pestana the balance because the damages far exceed the amount owed and the bad Contractor had the Contract with Pestana.
Pestana shared he is more of a roofing repair contractor and was not suitable for our job. Instead of a low sloping flat roof, we got a crooked, lopsided, peaked and wavy roof with wrong roofing and wrong drip edge materials and size, wrong color and bad workmanship. Pestana put on a different roof than what was specified in the permitted plans and approved by the building department.
